§ 1 DEFINITIONS
Business days – days from Monday to Friday excluding public holidays.
Account – a free function of the Store regulated by separate terms (an electronic service), which allows the Buyer to create an individual Account in the Store.
Consumer – a consumer within the meaning of the provisions of the Civil Code.
Buyer – any entity purchasing in the Store.
Terms and Conditions – these terms and conditions.
Store – the online store wlepka.net operated by the Seller at https://wlepka.net
Seller – RWDESIGN Tomasz Burghardt with its registered office in Padew Narodowa at ul. Złota 22, 39-340 Padew Narodowa, Poland, NIP 8172189275, REGON 380956652.

§ 2 CONTACT WITH THE SELLER

§ 3 TECHNICAL REQUIREMENTS

1. For the proper functioning of the Store, the following are required:
– a device with Internet access
– a web browser supporting JavaScript and cookies.

2. To place an order in the Store, in addition to the requirements specified in section 1, an active email account is required.

§ 4 PURCHASES IN THE STORE

1. Prices displayed in the Store are gross prices.
2. The Seller notes that the total price of the order consists of the price for the goods/services indicated in the Store and, where applicable, the costs of delivery of the goods.
3. The selected goods/services to be purchased should be added to the cart in the Store.
4. Then the Buyer selects from the options available in the Store: the method of delivery of the goods and the payment method for the order, and provides the data necessary to complete the order.
5. The order is placed at the moment of confirming its content and accepting the Terms and Conditions by the Buyer.
6. Placing an order is equivalent to concluding a sales agreement between the Buyer and the Seller.
7. The Seller will provide the Consumer with confirmation of the conclusion of the sales agreement on a durable medium at the latest at the time of delivery of the goods.
8. The Buyer may register in the Store, i.e. create an Account, or make purchases without registration by providing their data for each order.

§ 5 PAYMENTS

1. The order may be paid for, depending on the Buyer’s choice:
a. By standard bank transfer to the Seller’s bank account.
b. Via the PayNOW payment platform.

2. If the Buyer chooses advance payment, the order must be paid within 7 business days from placing the order.
3. The Seller informs that in the case of certain payment methods, due to their nature, payment for the order using that method is possible only immediately after placing the order.
4. The Seller informs Buyers making purchases in the Store that electronic invoices are used during order processing.

§ 6 ORDER FULFILLMENT

1. The Seller is obliged to deliver the goods or perform the service free from defects within up to 5 business days.
2. The order fulfillment time is indicated in the Store.
3. If the Buyer has chosen advance payment for the order, the Seller will begin processing the order after payment has been received.
4. If, within one order, the Buyer purchases goods with different fulfillment times, the order will be completed within the timeframe applicable to the item with the longest fulfillment time.
5. Countries to which delivery is carried out:
– Republic of Poland
6. Goods purchased in the Store are delivered depending on the delivery method chosen by the Buyer:
– Via courier company DPD
– Via courier company InPost

§ 7 RIGHT OF WITHDRAWAL

1. The Consumer has the right to withdraw from the agreement concluded with the Seller through the Store, subject to § 8 of the Terms and Conditions, within 14 days without giving any reason.
2. The withdrawal period expires after 14 days from the day:
a. on which the Consumer acquired possession of the goods or on which a third party other than the carrier and indicated by the Consumer acquired possession of the goods.
b. on which the Consumer acquired possession of the last item or on which a third party, other than the carrier and indicated by the Consumer, acquired possession of the last item in the case of an agreement requiring the transfer of ownership of multiple items delivered separately.
c. of concluding the agreement – in the case of a contract for the supply of digital content.
3. In order to exercise the right of withdrawal, the Consumer must inform the Seller, using the contact details provided in § 2 of the Terms and Conditions, of their decision to withdraw from the agreement by means of a clear statement (for example, a letter sent by post or information sent by email).
4. The Consumer may use the model withdrawal form provided at the end of the Terms and Conditions, but this is not mandatory.
5. To meet the withdrawal deadline, it is sufficient for the Consumer to send information concerning the exercise of the right of withdrawal before the withdrawal period has expired.

CONSEQUENCES OF WITHDRAWAL FROM THE CONTRACT
6. In the event of withdrawal from the concluded contract, the Seller shall refund to the Consumer all payments received from them, including the costs of delivery of the goods (except for additional costs resulting from the Consumer’s choice of a delivery method other than the cheapest standard delivery method offered by the Seller), without undue delay and within the statutory period from the day on which the Seller was informed of the Consumer’s decision to exercise the right of withdrawal.
7. The Seller shall refund the payment using the same means of payment as used by the Consumer in the original transaction, unless the Consumer has expressly agreed otherwise; in any case, the Consumer will not incur any fees in connection with this refund.
8. The Seller may withhold the refund until the goods have been received or until proof of their return has been provided, whichever occurs first.
9. The Seller requests that the goods be returned to the following address: ul. Złota 22, 39-340 Padew Narodowa, Poland.
10. The Consumer shall bear the direct costs of returning the goods.
11. The Consumer is liable only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
12. If the goods, by their nature, cannot be returned by regular post, the Consumer will also have to bear the direct costs of returning the goods. The estimated amount of these costs will be communicated by the Seller in the product description in the Store or during the ordering process.

§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

1. The right to withdraw from a distance contract does not apply to the Consumer in relation to contracts:
a. where the subject of the service is a non-prefabricated item manufactured according to the Consumer’s specifications or serving to satisfy their individualized needs.
b. where the subject of the service is an item that is liable to deteriorate rapidly or has a short shelf life.
c. where the subject of the service is an item delivered in a sealed package which cannot be returned after opening for health protection or hygiene reasons, if the package has been opened after delivery.
d. where the subject of the service is an item which, after delivery, due to its nature, is inseparably mixed with other items.
e. where the subject of the service is sound or visual recordings or computer software supplied in a sealed package if the package has been opened after delivery.
f. for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.
g. where the price or remuneration depends on fluctuations in the financial market beyond the trader’s control, which may occur before the withdrawal period expires.
h. for the supply of digital content not supplied on a tangible medium if the performance has begun with the Consumer’s express consent before the expiry of the withdrawal period and after being informed by the trader of the loss of the right of withdrawal.

§ 9 COMPLAINTS

1. In the event of a defect in the goods, the Buyer has the right to file a complaint regarding the defective goods based on statutory warranty rights regulated by the Civil Code or a guarantee, if one has been granted.
2. When exercising statutory warranty rights, the Buyer may, under the rules and within the time limits specified in the Civil Code:
a. submit a statement requesting a price reduction
b. in the case of a significant defect – submit a statement of withdrawal from the contract
c. request replacement of the goods with goods free from defects
d. request removal of the defect
3. The Seller asks that complaints under statutory warranty be submitted to the postal or electronic address indicated in § 2 of the Terms and Conditions.
4. If it turns out that for the complaint to be considered it is necessary to deliver the complained goods to the Seller, the Buyer is obliged to deliver the goods, and in the case of a Consumer at the Seller’s expense, to the address ul. Złota 22, 39-340 Padew Narodowa, Poland.
5. If an additional guarantee has been granted for the goods, information about it and its terms is available in the product description in the Store.
6. Complaints regarding the operation of the Store should be sent to the email address indicated in § 2 of the Terms and Conditions.
7. Complaints will be handled by the Seller within the statutory time limit.

OUT-OF-COURT METHODS OF HANDLING COMPLAINTS AND PURSUING CLAIMS
8. If the complaint procedure does not bring the result expected by the Consumer, the Consumer may, among others, use:
a. mediation conducted by the competent Regional Inspectorate of the Trade Inspection, to which an application for mediation should be submitted. As a rule, the procedure is free of charge. A list of Inspectorates is available here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
b. assistance of the competent permanent consumer arbitration court operating at the Regional Inspectorate of the Trade Inspection, to which an application for consideration of the case before the arbitration court should be submitted. As a rule, the procedure is free of charge. A list of courts is available at: https://www.uokik.gov.pl/wazne_adresy.php#faq596.
c. free assistance of a municipal or district consumer ombudsman.
d. the online ODR platform available at: http://ec.europa.eu/consumers/odr/.

§ 10 PERSONAL DATA

1. The controller of the personal data provided by the Buyer while using the Store is the Seller.
2. The Buyer’s personal data is processed primarily on the basis of the contract and for its performance, in accordance with the principles set out in the General Data Protection Regulation (GDPR) of the European Parliament and of the Council (EU). Detailed information regarding data processing by the Seller is included in the privacy policy available in the Store.

§ 11 RESERVATIONS

1. The Buyer is prohibited from providing unlawful content.
2. Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the Terms and Conditions. The contract is concluded for the duration and purpose of fulfilling the order.
3. Contracts concluded on the basis of these Terms and Conditions are concluded in the Polish language.
4. None of the provisions of these Terms and Conditions exclude or in any way limit the Consumer’s rights arising from applicable law.
5. Provisions concerning goods and sales contracts shall apply accordingly to digital content and contracts for the supply of digital content, unless the Terms and Conditions provide otherwise.
